The National Energy Regulator (NERSA) is a regulatory authority established as a juristic person in terms of Section 3 of the National Energy Regulator Act, 2004 (Act No. 40 of 2004). NERSA’s mandate is to regulate the electricity, piped-gas and petroleum pipeline industries in terms of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), Gas Act, 2001 (Act No. 48 of 2001) and Petroleum Pipelines Act, 2003 (Act No. 60 of 2003). The structure of the Energy Regulator consists of nine members, five of whom are part-time and four are full-time, including the CEO. The Energy Regulator is supported by a secretariat under the direction of the CEO. While the electricity industry has been regulated for the past ten years, the piped-gas and petroleum pipeline industries in South Africa will be regulated for the first time. In 2002, the Cabinet decided that the NER would be used as the basis to create the National Energy Regulator. In anticipation of the future development of these industries the Gas Act of 2001 and the Petroleum Pipelines Act of 2003 were passed to promote the orderly development of the piped-gas and petroleum pipelines industries. Both Acts mandated the establishment of a regulator.

The South African Petroleum Industry Association (SAPIA) was formed in July 1994 by 6 of South Africa's refining and marketing companies: BP Southern Africa (Pty) Ltd Chevron South Africa (Pty) Ltd Engen Petroleum Ltd Shell South Africa (Pty) Ltd Total South Africa (Pty) Ltd Zenex Oil (Pty) Ltd (no longer a member) to represent the common interests of the petroleum refining and marketing industry in South Africa; and to promote understanding of the industry's contribution to economic and social progress with all stakeholders. Zenex Oil (Pty) Ltd has since become a part of Engen Petroleum Ltd and is no longer a member. Sasol Ltd and TEPCO Petroleum (Pty) Ltd joined SAPIA during 2000. Mossgas (Pty) Ltd became a member of Sapia in 2001. With the formation of PetroSA (Pty) Ltd in 2002, PetroSA replaced Mossgas as member. TEPCO Petroleum (Pty) Ltd became part of Shell South Africa (Pty) Ltd during 2002.
